By purchasing, accessing, or using any ThermaNest product, you agree to the following Terms & Conditions.

1. Product Purpose & Intended Use

ThermaNest products are designed for general wellness, relaxation, and non-medical heat therapy purposes only.

 

ThermaNest products are not medical devices and are not intended to diagnose, treat, cure, mitigate, or prevent any medical condition or disease.

2. Medical & Health Disclaimer 

 

Any information provided by ThermaNest, including on our website, packaging, manuals, social media, or marketing materials, is provided for general informational and wellness purposes only and does not constitute medical advice.

 

You must not rely on Thermanest products as a substitute for professional medical advice, diagnosis, or treatment.

 

You should consult a qualified healthcare professional before using this product if you:

 

  • Have any medical condition

  • Have cardiovascular or respiratory issues

  • Are pregnant or breastfeeding

  • Have heat sensitivity or circulation issues

  • Are taking medication that affects heat tolerance

  • Feel unwell or unfit for heat exposure

Use of ThermaNest products is entirely voluntary and undertaken at your own risk.

 

To the maximum extent permitted by law, Thermanest disclaims all liability for injury, illness, complications, or adverse reactions arising from the use or misuse of the product.

 

Nothing in this disclaimer excludes rights provided under Australian Consumer Law.

3. Heat Exposure & Safety Warnings

​

ThermaNest products generate heat, and improper use may result in burns, dehydration, dizziness, fainting, or serious injury.

 

You acknowledge and agree to the following:

 

  • Do not exceed recommended session durations - 30 minutes

  • Do not fall asleep while using the product

  • Maintain adequate hydration before and after use

  • Exit immediately if you feel dizzy, light-headed, nauseous, overheated, or unwell

  • Do not use if damaged or malfunctioning

  • Do not use under the influence of alcohol or drugs

  • Do not leave the product unattended while in use

Failure to follow safety instructions may result in injury and void any warranty or liability protections.

4. Age Restriction (16+)

​

ThermaNest products are strictly intended for use by individuals aged 16 years and over.

 

Persons under 16 years of age must not use ThermaNest products under any circumstances.

 

Users aged 16–17 years may only use the product:

 

  • With parental or legal guardian consent

  • Under adult supervision

  • In strict accordance with all safety instructions

 

By purchasing or using a ThermaNest product, you confirm that you meet the minimum age requirement or are legally authorized to consent on behalf of the user.

5. User Responsibility

By using a ThermaNest product, you acknowledge that:

 

  • You have read and understood all warnings and instructions

  • You accept responsibility for safe and correct usage

  • You assume all risks associated with heat exposure

 

ThermaNest is not responsible for misuse, improper setup, unauthorized modification, or failure to follow instructions.

6. Electrical & Fire Safety

 

  • Use only approved power components supplied or specified by ThermaNest

  • Do not modify electrical components

  • Do not use near water or in damp conditions and do not submerge any part of the product

  • Disconnect after use

 

Improper electrical use may result in injury or fire and voids warranty.

7. Warranty

 

ThermaNest products include a limited warranty covering manufacturing defects only.

 

The warranty does not cover:

 

  • Normal wear and tear

  • Damage caused by misuse, neglect, or improper storage

  • Unauthorized repairs or modifications

 

Proof of purchase is required for all warranty claims.

8. Returns & Refunds

​

Due to hygiene and personal use considerations, ThermaNest products may not be eligible for return once opened or used, except where required under Australian Consumer Law.

 

Any damage or fault must be reported within 7 days of delivery.

9. Wholesale & Reseller Terms

 

Authorization

​

Wholesale or reseller customers (“Resellers”) may sell ThermaNest products only with written approval from ThermaNest.

 

Approval may be revoked at any time.

​

 

Marketing & Claims

 

Resellers must:

 

  • Not represent ThermaNest products as medical devices

  • Not make medical, therapeutic, or clinical claims

  • Follow all branding and marketing guidelines provided by ThermaNest

Liability & Indemnity

​

Resellers accept full responsibility for customer education, safe use guidance, and compliance with applicable laws.

 

Resellers agree to indemnify and hold harmless ThermaNest from any claims, damages, or liabilities arising from:

 

  • Misrepresentation

  • Improper instruction

  • Unauthorized claims

10. Limitation of Liability

 

To the maximum extent permitted by law:

 

  • ThermaNest is not liable for indirect, incidental, or consequential damages

  • Liability is limited to the purchase price of the product

11. Intellectual Property

​

All ThermaNest branding, product designs, content, manuals, and imagery are the intellectual property of ThermaNest and may not be reproduced without written permission.

12. Governing Law

​

These Terms & Conditions are governed by the laws of Western Australia, Australia.
